1. Use of the Site

The Site provides real estate information, property listings, and tools to help you connect with reThought. You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site or its content for any commercial purpose other than identifying properties you may be interested in purchasing.
• Scrape, harvest, copy, frame, or republish listing data or other Site content except as expressly permitted.
• Interfere with or disrupt the Site, or attempt to gain unauthorized access to any system or data.
• Submit false, misleading, or unlawful information, or impersonate another person.
• Use any automated means to access the Site in a way that burdens our infrastructure.

2. No Brokerage Relationship by Use Alone

Using the Site, browsing listings, or submitting an inquiry does not by itself create an agency, brokerage, or fiduciary relationship between you and reThought. A brokerage relationship is formed only through a separate written agreement and as required by applicable Wisconsin or Florida real estate law. Nothing on the Site is an offer to buy or sell real property.

3. Listing Information and IDX

Property listings are provided through MLS Internet Data Exchange (IDX) feeds delivered by our data provider, Repliers. Florida listings come from Stellar MLS and Wisconsin listings come from Metro MLS / Wisconsin MLS, courtesy of the listing brokerages.

Information is deemed reliable but not guaranteed. Listing data is subject to prior sale, change, or withdrawal, and may contain errors, omissions, or out-of-date information. Square footage, lot size, taxes, fees, and other details should be independently verified. Listing data is provided solely for consumers' personal, non-commercial use and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing. reThought does not guarantee the accuracy of any listing or estimate (including any home-value estimate or payment calculator), which are provided for general information only.

4. Accounts

Some features (such as saving homes and searches) require an optional account. You are responsible for the accuracy of your account information and for maintaining the confidentiality of your credentials. You agree to notify us of any unauthorized use of your account.

5. Communications and SMS Consent

By submitting your contact information, you agree that reThought and its agents may contact you about your inquiry by phone, email, and — where you provide a mobile number and consent — by text message (SMS) through our provider, Twilio.

• Consent to receive texts is not a condition of any purchase. Message and data rates may apply, and message frequency varies.
• Reply STOP to opt out of texts at any time, or HELP for help. We handle messaging consistent with the Telephone Consumer Protection Act (TCPA).

6. Intellectual Property

The Site and its content — including text, design, graphics, logos, and the "reThought Real Estate®" name and marks — are owned by reThought or its licensors and are protected by intellectual property laws. Except for MLS listing data (governed by the applicable MLS rules) and content you submit, you may not copy, modify, distribute, or create derivative works without our prior written permission. Third-party names and marks (including media outlet names) are the property of their respective owners.

7. Copyright Complaints (DMCA)

We respect intellectual property rights. If you believe content on the Site infringes your copyright, please follow the procedure in our DMCA Policy.

8. Third-Party Services and Links

The Site relies on and links to third-party services (for example, IDX/MLS data, mapping, messaging, analytics, and advertising providers). We do not control and are not responsible for third-party services or websites, and your use of them is governed by their own terms and policies.

9. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that listing data, estimates, or other information are accurate or current.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, reThought and its agents, members, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of (or inability to use) the Site or reliance on its content. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify and hold harmless reThought and its agents and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws rules, except that activities and transactions involving Florida property are also subject to applicable Florida law. You agree to the exclusive jurisdiction of the state and federal courts located in Milwaukee County, Wisconsin for disputes not subject to a separate transaction agreement.
